Definitions
Conflict of interest – a situation in which the declaring subject has a personal interest that influences, or could influence the impartial and objective exercise of the obligations and responsibilities incumbent upon them according to the law.
Potential conflict of interest – represents a situation in which the personal interests of the declaring subject could lead to the emergence of a real conflict of interest and which is declared under the conditions of articles 4–7. The superior hierarchical manager provides consultation regarding avoiding the occurrence of a real conflict as a result of the potential one.
Real conflict of interest – occurs when the declaring subject is called upon to resolve a request/application, to issue an administrative act, to conclude directly or through a third party a legal act, to make a decision or to participate in making a decision in which they have personal interests or which concerns persons close to them, natural and legal persons with whom they have patrimonial relations and which influences or may influence the impartial and objective exercise of the mandate, public function or public dignity position.
Consummated conflict of interest – represents the act of the declaring subject of resolving a request/application, issuing an administrative act, directly concluding or through a third party a legal act, making or participating in making a decision in exercising the mandate, public function or public dignity position in violation of the provisions.
Procedures
The employee who finds themselves in a conflict of interest will immediately inform the head of the subdivision, but no later than 3 days from the date of discovery, through a written declaration in free form.
Within all General Police Inspectorate entities, a Register of declarations regarding conflicts of interest is established as well as a designated person responsible for registering declarations regarding conflicts of interest.
In case the head of the entity is unable to resolve the conflict of interest, they notify the National Integrity Authority.
